Because a settlement fiduciary's obligation to do what's best for their ward does not always align itself with the dynamics of settlement or the short term goals of the parties. Their role is unique; so must be their support services.
Regularly called in late yet asked to complete their work quickly, the pressure to accept a given settlement scenario can be intimidating. Whether pressured by a looming trial date, forceful judge or mediator, strong-willed family members, or even a trial attorney with a heavy caseload and anxious partners, it takes a strong fiduciary to maintain their poise.
Consistent use of a disciplined evaluation methodology can greatly relieve such pressures. To do this effectively, settlement fiduciaries must have access to complete, unbiased information on the various settlement alternatives available and the technical skills to effectively evaluate and compare them. If they lack the training or experience to do this themselves, they should retain competent experts to assist them.
